Terms of Service

These terms are the agreement between you and Kora Labs Group LLC for using Tender Machine.

1. Acceptance

Tender Machine (the “Service”) is operated by Kora Labs Group LLC (“we,” “us”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you don’t agree, don’t use the Service.

2. Eligibility

You must be at least 13 years old (and old enough to form a binding contract where you live, or have a parent or guardian’s consent) to use the Service.

3. Your account

Keep your account secure and don’t share access. You’re responsible for activity under your account, and should tell us promptly of any unauthorized use.

4. What the Service is — and isn’t

Tender Machine is an educational practice for developing judgment (“taste”), provided for general informational and self-improvement purposes. We make no promise of any particular result — skill, career, or otherwise. Nothing here is professional advice.

5. Your content

You keep ownership of the photos, text, and other content you create (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content to operate, improve, and promote the Service — and, for content you make public, to show it to other users. You’re responsible for Your Content and confirm you have the rights to share it. When you delete content, it is removed from the Service immediately and permanently for all users; a private copy remains in your account’s private log (described in the Privacy Policy) until you delete your account.

6. Community & acceptable use

Be decent. You agree not to:

  • post content that’s illegal, infringing, hateful, harassing, or invasive of others’ privacy;
  • upload images you don’t have the right to share;
  • misuse, scrape, overload, or try to break or reverse-engineer the Service;
  • impersonate others or misrepresent your affiliation.

We may remove content or suspend accounts that violate these Terms, to protect the community’s quality and safety.

7. Our intellectual property

The Service — including the lessons, written practice, software, and brand — is owned by Kora Labs Group LLC and protected by law. We grant you a personal, non-transferable, revocable license to use it for its intended purpose. Don’t copy, resell, or redistribute our content without permission.

8. Subscriptions, billing, cancellation & refunds

  • The Service is a paid annual subscription — yearly only; there is no monthly plan. The Taste Foundation Series is included with your subscription: you unpack it inside the app, and it’s yours to keep.
  • Subscriptions are sold and managed on our website only — never through in-app purchase or the App Store. Orders are processed by our merchant of record, Lemon Squeezy, who handles order-related inquiries, billing and payment processing. Subscriptions renew automatically at the then-current price until you cancel.
  • You can cancel anytime from your account. Cancellation stops the next renewal; access continues until the end of the period you’ve paid for.
  • Refund policy: all payments are final. We do not offer refunds or prorations, except where applicable law requires otherwise (any statutory cooling-off rights you have are unaffected, and refunds required by law are honored through Lemon Squeezy).
  • Prices may change; we’ll give notice before a change affects you. Taxes may apply.

9. Third-party services

The Service relies on third parties (e.g. hosting, email, payments). We’re not responsible for their acts or omissions, and their terms may also apply to you.

10. Termination

You can stop using the Service and delete your account anytime. We may suspend or terminate access if you violate these Terms or to protect the Service. Sections that by their nature should survive (ownership, disclaimers, liability, governing law) survive termination.

11. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. We don’t warrant that it will be uninterrupted or error-free, or that it will improve your taste or skills.

12. Limitation of liability

To the fullest extent permitted by law, Kora Labs Group LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or US $50.

13. Indemnification

You agree to indemnify and hold Kora Labs Group LLC harmless from claims arising out of Your Content or your misuse of the Service or violation of these Terms.

14. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. Courts located in that jurisdiction have exclusive venue, except where applicable law lets you bring a claim elsewhere.

15. Changes

We may update these Terms. We’ll update the date above and, for material changes, give clearer notice. Continued use after changes means you accept them.
